Terms of Use for Gramoji - Indian Social Media Platform

Welcome to Gramoji – the Indian social media platform created for everyone. By accessing or using Gramoji (hereinafter referred to as “the Platform”), you agree to comply with and be bound by these Terms of Use (the "Terms"). If you do not agree with these Terms, please do not use the Platform.
Introduction
These Terms of Use govern your use of Gramoji, a social networking platform designed for people across India. These Terms constitute a legal agreement between you and Gramoji. By using the Platform, you accept and agree to be bound by these Terms, including any future amendments.
Eligibility
To use Gramoji, you must be of legal age (at least 18 years old or the legal age in your jurisdiction) to enter into a binding contract. By accessing or using Gramoji, you confirm that you meet these eligibility requirements.
Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your username and password, and for any activities that occur under your account. You agree to notify Gramoji immediately if you become aware of any unauthorized access or use of your account.
User Conduct
You agree to use the Platform only for lawful purposes and to comply with the following guidelines:
Do not post, upload, or share illegal, harmful, abusive, defamatory, or inappropriate content.
Do not engage in spamming, harassment, or sending unsolicited communications.
Do not infringe upon the intellectual property or privacy rights of others.
Do not engage in fraudulent, misleading, or malicious activities.
Violating these guidelines may result in suspension or termination of your account, without prior notice.
Content Ownership
You retain full ownership of the content you upload to Gramoji. However, by submitting content to the Platform, you grant Gramoji a non-exclusive, royalty-free, worldwide license to use, display, modify, and distribute your content within the Platform for the purpose of operation, promotion, and improvement of the services.
Privacy
Your use of the Platform is governed by Gramoji’s Privacy Policy, which outlines how your personal information is collected, used, and protected. Please review the Privacy Policy to understand your rights regarding the data you provide to us.
Third-Party Links
Gramoji may include links to third-party websites or services that are not operated by Gramoji. We are not responsible for the content, privacy policies, or practices of third-party websites. Accessing these third-party links is at your own risk.
Storage Limitation
Gramoji provides limited storage for photos, files, and content. Due to storage constraints, Gramoji reserves the right to delete old photos, files, and other content as necessary to maintain optimal platform performance. Users should be aware that their data may be removed at any time without prior notice.
Feature Limitations
Some features of Gramoji, such as video calls, group messaging, and live streaming, are provided using Agora’s free account, which may limit their availability or functionality. Gramoji does not guarantee uninterrupted access to these features and users should expect potential limitations.
Wallet Recharge & Pro Membership
Gramoji offers optional features, including wallet recharge and pro membership. These are not required to use the Platform but provide additional functionality and benefits, such as premium content access, increased storage, or other perks. Payments for these services are processed through secure methods, and all fees are non-refundable, except as required by law.
Advertisements & Revenue
Gramoji is free to use, and the Platform generates revenue by showing advertisements to users. In addition to third-party ads, Gramoji allows users to create and serve their own advertisements within the platform. When users create ads, Gramoji will deduct the relevant amount from their Gramoji wallet, as specified at the time of purchase.
By using Gramoji, you consent to the display of advertisements and the use of your Gramoji wallet for ad-related transactions.
Dispute Resolution
In the event of a dispute, Gramoji encourages users to resolve the issue amicably through direct communication. If necessary, disputes may be handled through alternative dispute resolution methods such as mediation or arbitration, depending on the applicable laws in the user's jurisdiction.
Account Termination
Gramoji reserves the right to suspend or terminate any user account at its sole discretion, without notice, if the user violates these Terms of Use. This may include unauthorized activities, content violations, or misuse of the Platform. Upon termination, all rights granted to the user under these Terms will immediately cease.
Limitation of Liability
Gramoji is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Platform. This includes damages from downtime, data loss, or issues resulting from third-party services such as Agora’s limitations. Gramoji's liability is limited to the amount paid by the user for Pro Membership or services within the past 6 months.
Modification of Terms
Gramoji reserves the right to modify, amend, or update these Terms of Use at any time, at its sole discretion. Users will be notified of any significant changes. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.
Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the jurisdiction where Gramoji operates. By using the Platform, you agree that any legal disputes will be subject to the exclusive jurisdiction of the courts, regardless of your location, and will be resolved in accordance with international law principles. You consent to the resolution of disputes in a manner determined by Gramoji, which may include arbitration or other dispute resolution methods, at Gramoji's discretion.
User Responsibility
You agree to use Gramoji responsibly and in compliance with applicable laws. This includes respecting intellectual property rights, refraining from fraudulent activities, and ensuring that your use of the Platform does not harm others or violate their rights.
Advertising Policy
If you wish to create advertisements on Gramoji, you must follow the advertising guidelines and policies established by the Platform. All advertisements must comply with legal, ethical, and platform-specific standards. Gramoji reserves the right to reject or remove any ad that does not meet these criteria.
Refunds
All payments made for Pro Membership or any other paid services on Gramoji are non-refundable, except where required by law. Please review the specific service’s terms for any applicable refund policies.
Platform Availability
Gramoji does not guarantee that the Platform will be available at all times, and access may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues. Gramoji is not responsible for any interruption in service caused by these factors.
User-Generated Content
You are solely responsible for the content you post, upload, or share on Gramoji. Gramoji is not responsible for the accuracy, legality, or quality of user-generated content, and users agree to indemnify Gramoji from any liability related to such content.
Termination of Service
Gramoji reserves the right to suspend or terminate all or part of its services at its discretion for reasons including but not limited to legal compliance, operational changes, or user misconduct. Termination may occur with or without prior notice.
Email Communication
By registering with Gramoji, you consent to receiving emails related to your account, including notifications, updates, promotional offers, and other system-related messages. You can opt-out of marketing emails by following the instructions in those emails.
Changes to the Service
Gramoji may modify, add, or remove features or services at its discretion. Any significant changes will be communicated to users, but continued use of the Platform constitutes acceptance of such modifications.
No Warranty
Gramoji makes no warranty regarding the availability, functionality, or performance of the Platform. It is provided "as is" without any express or implied warranty. Gramoji disclaims all warranties, including the implied warranties of merchantability and fitness for a particular purpose.
Indemnification

All intellectual property rights in Gramoji, including trademarks, copyrights, and patents, are owned by Gramoji. Users are granted a limited, non-exclusive license to use the Platform according to these Terms. No rights to the Platform's intellectual property are transferred to users.
